JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with S.Tr. No. 668/2022, arising out of Musarigharari P.S. Case No. 132/2022, registered for the offence punishable under Sections 394, 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submit that the petitioner is quite innocent and has falsely been implicated in this case. There is no evidence against the petitioner except the confessional statement of co-accused namely Devendra Kumar Sharma @ Nanhki. Petitioner is in custody since 19.10.2022. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.6547 of 2023(2) dt.16-05-2023 2/2 the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-VIII, Samastipur in connection with S.Tr. No. 668/2022, arising out of Musarigharari P.S. Case No. 132/2022.
