2.This application for regular bail arises out of Mahila P.S. Case No. 44 of 2016, disclosing offences punishable under Sections 323,341,498A,506/34 of the Indian Penal Code. The petitioner is the husband of the informant, who is in custody since 21.09.2020. There is allegation in the First Information Report of demand of dowry and torture therefor. Learned counsel appearing on behalf of the petitioner has submitted that the matrimonial discord between the petitioner and the informant is the real reason, which has led to lodging of the First Information Report. He further submits that there is no chance of the petitioner fleeing away from the course of investigation or trial, if he is allowed regular bail by this

Patna High Court CR. MISC. No.4599 of 2020(4) dt.28-05-2020 2/2 Court. The petitioner is in custody since 21.09.2020. Mrs. Pronati Singh, learned Additional Public Prosecutor, appearing on behalf of the State has opposed the prayer for bail.

However, considering the nature of allegation, submission made on behalf of the petitioner and the fact that the petitioner is in custody since 21.09.2020, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Sasaram, Rohtas in Mahila P.S. Case no. 44 of 2016.
