It is submitted by learned counsel for the petitioner that neither petitioner is named in the F.I.R nor recovery has been made from his possession nor the petitioner has been put on T.I.P. A statement to that effect has been made in para 7 of the petitioner.

Considering the fact that petitioner has not been put on T.I.P, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S.
