Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504 of the Indian Penal Code.

Patna High Court CR. MISC. No.17262 of 2021(2) dt.15-12-2021 2/3 Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 2 namely Rameshwar Ram since he has been arrested.

Permission is accorded.

Accordingly, the petition with regard to petitioner No. 2 is permitted to be withdrawn. It is alleged that these petitioners along with four unknown came at the door of the informant and started abusing him. Thereafter, petitioner No. 2 ordered to assault, whereupon petitioner No. 1 assaulted with axe on the head of the informant, as a result of which the fell down and became unconscious.

It is submitted by learned counsel for the petitioner No. 1 that there is counter version of the occurrence also and petitioners' side also received injuries. Moreover, the occurrence is alleged to have taken place on 22.05.2020 at 8:00 P.M. but the injury report of the injured shows that injured was examined

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner No. 1, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Dighwara P.S. Case No. 147 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Shageer/- U T
