Petitioner is not named in the first information report but in course of investigation, some witnesses stated that daughter of petitioner had illicit relation with one Vipul Sharma who happens to be brother in law of son of the petitioner and deceased being agnate of petitioner made protest against the aforesaid illicit relation which caused annoyance to the petitioner and her family members and they assaulted the deceased one month prior to the alleged occurrence for which a criminal case was lodged. Learned counsel appearing for the informant submits that in course of investigation, call details of petitioner and other
Patna High Court Cr.Misc. No.32859 of 2015 (3) dt.20-08-2015 2/2 accused were verified and their location was detected. Even if the submissions advanced on behalf of the informant assumed to be true, then also, none has seen the actual killing of the deceased and petitioner is said to be a conspirator. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Gaya in connection with Jehanabad Rail P.S. Case No. 39 of 2014.
