JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 This is an application for grant of anticipatory bail in connection with Gopalganj P.S. Case No. 416 of 2013, disclosing offences under Sections 414, 120(B) of the Indian Penal Code.

Allegation is of recovery of stolen motorcycle and the petitioner is not named in the F.I.R., later on his name transpired on confessional statement.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing has been recovered from his possession and he has no criminal antecedent.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that the petitioner is

Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the court below and make prayer for regular bail, which will be considered on its own merit, if possible, to be disposed of on the same day.
