The petitioner in this case is seeking regular bail in connection with Harnaut Excise P.R. Case No. 08-2019-20 registered for the offence punishable under Section 30(a)of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that illicit liquor has not been recovered from his house rather the same has been recovered from a vacant field.

However, learned APP for the State submits that the petitioner is said to have fled away on seeing the raiding party and has surrendered only on 07.01.2020. He has also a criminal antecedent of the same nature.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.4553 of 2020(2) dt.23-01-2020 2/2 wherein the name of the petitioner has transpired in this case and has been involved while being on bail in another case of similar nature, this Court taking into consideration the period of custody, at this stage, is not inclined to grant regular bail to the petitioner. His prayer for bail is refused.

The petitioner may, however, renew his prayer for bail after expiry of a reasonable period.
