The petitioner is in custody since 28.03.2016 in connection with Barhara P.S. Case No. 136/2016 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code 47(a) of the Bihar Excise Act.

Considering the facts and circumstances of the case, that the alleged recovery was made prior to lodging of this case and amendment of New Bihar Excise Act which came into effect from 01.04.2016, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two
