Heard learned counsel for the parties.

This application for grant of regular bail arises out of S.T. No. 179 of 2020 arising out of K.Nagar P.S. Case No. 457 of 2019, disclosing offences punishable under Sections 392 and 365 of the Indian Penal Code.

Petitioner's prayer for regular bail was earlier rejected by an order dated 05.06.2020 passed in Cr. Misc. No. 2804 of 2020 with a liberty to renew his prayer for bail, if there was no substantial progress in the trial after six months. Accordingly, this application renewing prayer for bail has been filed.

No.17179 of 2021(2) dt.07-07-2021 2/2 It has been submitted on behalf of the petitioner that the petitioner's name transpired during the course of investigation and other similarly situated persons have been allowed regular bail by this Court by orders, which has been brought on record by way of Annexures 3 and 4. On perusal of the orders dated 17.02.2020 passed in Cr. Misc. No. 86870 of 2019(Raushan Gupta Vs. State of Bihar) and 04.12.2020 passed in Cr. Misc. No. 26494 of 2020( Suraj Kumar Vs. State of Bihar) as also the order dated 08.01.2021 passed in Cr. Misc. No. 31227 of 2020 (Md. Alam Vs. State of Bihar), I find substance in the submission made on behalf of the petitioner that the similarly situated persons have been granted regular bail by this Court.

Considering the above, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnia in S.T. No. 179 of 2020 arising out of K.Nagar P.S. Case No. 457 of 2019.
