JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehend his arrest in a case registered for the offence punishable under sections 420, 467, 468, 471, 120B of the Indian Penal Code and 30(A)/31/32/41(A) of the Bihar Prohibition and Excise Act and 25(1-b)a/26/35 of the Arms Act. There is recovery of 2176.740 liters of illicit foreign liquor from different vehicles.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner nor driver of the vehicles. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel for the State submits that the huge number of liquor recovered from the conscious possession of

Considering the facts that the petitioner has got criminal antecedent of similar nature, prayer for anticipatory bail is rejected.
