2. Learned counsel appearing on behalf of O.P. No. 3 (Municipal Commissioner, Gaya Municipal Corporation), referring to the statements made in paragraphs 4 and 5 of the show cause, submitted that the petitioner has been paid the due amount payable to him. He further submitted that a payment chart has been brought on record along with the show cause which has been annexed as Annexure-A series, detailing the various heads under which the amounts have been paid to the petitioner.

Per contra, learned counsel appearing on behalf of the petitioner submitted that, with regard to pay fixation in terms of the Pay Commission recommendations, the differential amounts arising out of the Fifth Pay Revision and the Sixth Pay Revision have already been paid to the petitioner. However, so far as, the Seventh Pay Revision is concerned, the consequential benefits have not yet been paid to the petitioner. Learned counsel further submitted that the petitioner seeks liberty to file a fresh representation furnishing the necessary details and calculations, so that the due amount, if found payable, may be released in accordance with law.

4. Accordingly, the present contempt petition is consigned with aforesaid liberty.
