The present writ petition has been filed for the following relief:- " For issuance of an appropriate writ, order or directing the respondent no. 2 not to take any further construction over the land in dispute of Title Suit No. 5220 of 2014 pending in the Court of learned Senior Civil Judge 3rd Patna by way of creating third party interest entering into a tenancy agreement with ICICI Bank inspite of status quo order dated 14.08.2014 passed by the learned Senior Civil Judge 3rd, Patna."

3. It is the grievance of the petitioners that despite the pendency of Title Suit No. 5220 of 2014 before the competent

Patna High Court CWJC No.14272 of 2017(3) dt.24-06-2025 2/2 Civil Court, Patna and an order of status quo passed by the said Court and way back in the year 2014-15 dated 14.08.2014, the defendants-respondents herein are neither appearing nor accepting said order and this forced them to prefer the present petition.

In the opinion of this Court, when the matter is already pending before the Title Court and an order of statusquo has also been passed, if there is any violation, the petitioners-plaintiffs have all the rights to inform the concerned court so that appropriate orders is/are passed against the respondents-defendants. This Court is afraid, the Writ Court cannot pass any order, when the matter is pending before the Competent Civil Court.

5. The writ petition is accordingly disposed of with request to the Title Court to look into the matter and if an appropriate petition is filed, the same be expedited and the Court has duty to see to it that the order passed by it is respected/ implemented.
