The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 498A and 34 of the Indian Penal Code.

The informant alleged that Karu Yadav informed him that his daughter was suffering from abdominal pain. The informant went there and found his daughter dead. The informant made allegation that his son-in-law and other family members were always torturing his daughter. The marriage of his daughter was solemnized ten years ago and she got one son and two daughters.

It is submitted that the son of the deceased had stated in his statement under Section 164 of the Cr.P.C., that his mother

Patna High Court Cr.Misc. No.33324 of 2015 (2) dt.20-08-2015 2/2 died due to illness and she was not quarreling with any other persons. The post-mortem report shows no external injury. The viscera report was kept reserved.

Considering the facts aforesaid and the fact that after ten years of the marriage the wife of the petitioner died due to abdominal pain and no complain was ever lodged about the demand of dowry and torture, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.
