The petitioner is languishing in custody since 16.12.2015 in connection with Nanpur P. S. Case No. 357 of 2015 for the offences instituted under Sections 363 and 366(A)/34 of the Indian Penal Code.

The prosecution story, in brief, is that on 09.12.2015, the minor daughter of the informant, namely, Manti Kumari, aged about 12 years was kidnapped by the petitioner and other co-accused for the purpose of marriage or to sell her. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.12.2015. Chargesheet has

Patna High Court Cr.Misc. No.22511 of 2016 (4) dt.01-08-2016 2/2 been submitted in the present case. The petitioner has got no criminal antecedent. The main allegation is against co-accused, namely, Bikau Ram. The petitioner has been made accused in the present case merely for the reason that he happens to be the father of the said co-accused, Bikau Ram, who is said to have married with the victim girl. The petitioner is aged about 65 years. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Nanpur P. S. Case No. 357 of 2015.
