JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-08-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.
The petitioners apprehend their arrest in connection with Chanan P.S. Case No. 126 of 2021, registered for the offences punishable under Sections 272, 273, 34 IPC and 30 (a) (b) (c) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsels for the petitioners have submitted that the petitioners were not arrested at the spot. Nothing was recovered from their possession and all the petitioners except Pankaj Kumar @ Pankaj Ram are the persons of clean antecedents. But considering the fact by virtue of Section 76 (2), no privileges of anticipatory bail can be entertained. The petition is being disposed of with the observations that if the petitioners surrender before the court below and make a prayer for regular bail that shall be disposed of on its own merit, on the same day of its filing without being prejudiced by this order.
