In this case, the petitioner is seeking anticipatory bail in connection with Kuchaikote P.S. Case No. 346 of 2018 registered for offence punishable under sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Allegation has been made that the accused persons including petitioner were insisting the informant to withdraw the case running against them but the informant refused to withdraw the case whereupon all accused persons started assaulting with different weapons.

It has been submitted that case and counter case from both sides, there is a free fight and both sides have received injury.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by the order of this Court, will take decision in accordance with law.
