Case no. 186/2014 registered under sections 394, 302, 201 and 412/34 of the IPC and accordingly, both the above stated petitions are being disposed of by this common order.
Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.
Patna High Court Cr.Misc. No.33901 of 2014 (3) dt.19-01-2015 Although petitioners are named in the first information report but admittedly, informant is not an eye-witness of alleged occurrence and he gave names of the petitioners in alleged crime on the basis of suspicion.
In course of investigation, one witness Renu Devi claimed that prior to alleged occurrence, petitioners and deceased came to her hotel to take meal and thereafter petitioners as well as deceased went to their respective shops and except the aforesaid material, there appears to be nothing against the petitioners. Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar Singh, Judicial Magistrate, Ist Class, Muzaffarpur/ concerned court in Kurhani P.S. Case no. 186/2014.
