The petitioner seeks bail in a case under Sections 328, 379, 34, 411 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 15.10.2014 passed in Cr. Misc. No. 39101/2014 with an observation that if the trial is not concluded within nine months from the date of receipt/production of a copy of the order, the petitioner may renew his prayer for bail. It is submitted that only charges have been framed and no prosecution witness has been examined. The petitioner moved for bail after remaining in jail for more than nine months from the date of the order passed in Cr. Misc. No. 39101/2014. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond

Patna High Court Cr.Misc. No.34968 of 2015 (2) dt.05-08-2015 2/2 of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Addl. Sessions Judge, Muzaffarpur in Muzaffarpur Rail P.S. Case No. 62 of 2013, corresponding to S. Tr. No. 394/14.
