NILU AGRAWAL ORAL ORDER 07-02-2019 Heard learned counsel for the petitioner, learned counsel appearing for the State as well as the learned counsel appearing for the Bihar Industrial Area Development Authority, Patna (hereinafter referred to as, 'the Authority'). The petitioner's uncle retired from service on 31.06.1993 and died on 31.01.2012. All the dues were paid to the petitioner in the year 2017, after he produced a certificate of being legal heir. Petitioner has filed representation for payment of statutory interest for delay in clearing the retiral dues of the erst-while employee, as the retiral dues were paid after 24 years after the retirement of the erst-while employee. Considering the nature of claim, made by the petitioner, the petitioner is directed to file a fresh representation

Patna High Court CWJC No.1946 of 2019(2) dt.07-02-2019 2/2 before respondent no. 2, the Managing Director, Bihar Industrial Area Development Authority, Udyog Bhawan, Gandhi Maidan, Patna, which will be disposed of within a period of three months from the date of filing of such presentation. Any statutory interest would be paid within one month thereafter. If the said interest is not admissible to the petitioner, the same shall be communicated to the petitioner by speaking order sent through the registered post.
