The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant alleged that his son, Indal Baitha, was working in the brick kiln of Ram Naresh Bhartiya and Manbodh Singh. Some wages was lying due and his son left the work in the brick kiln but the accused persons came and took his son thereafter his son was killed.

It is submitted that prior to filing of the complaint petition by the complainant/ informant the informant himself filed U. D. case on 19.04.2007 against Ram Naresh Bhartiya, Manbodh Singh and the petitioner. The petitioner happens to be relative of the informant. The petitioner has got no enmity with the informant

Patna High Court Cr.Misc. No.35156 of 2015 (2) dt.21-08-2015 2/2 or his son. The son of the informant died due to snake bite. Ram Naresh Bhartiya and Manbodh Singh, owner of the brick kiln, have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 29072 of 2008.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashish Mishra, learned Judicial Magistrate, 1st class, Gopalganj in Bhore P.S. Case No. 78 of 2007 (G. R. No. 1145/2007).
