Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 307, 379 and 385/34 of the Indian Penal Code. Allegation against the petitioner is of commission of assault at the head of the informant. There is case and counter case.

Since the petitioner had knowledge that his act might cause death, in my view, this is not a fit case for grant of anticipatory bail. Hence prayer is refused in connection with

Patna High Court CR. MISC. No.16667 of 2021(2) dt.23-11-2021 2/2 Bairiya P.S. Case No. 430 of 2020.

In the event of surrender of the petitioner within two weeks, prayer for regular bail shall be considered without being prejudiced by this Order.
