The petitioner seeks regular bail in connection with Tatarpur P.S. Case No. 247 of 2019 for the offence punishable under Sections 379, 411 of the Indian Penal Code and Sections 37(B), 37(C) Bihar Prohibition and Excise (Amendment) Act, 2018.

The allegation is regarding the petitioner having been found in an inebriated condition and is stated to be creating commotion and had engaged in creating nuisance. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and is languishing in custody since 21.09.2019.

Having regard to the facts and circumstances of the

No.4699 of 2020(2) dt.23-01-2020 2/2 case and considering the submissions advanced by the learned counsel for the petitioner coupled with the fact that the petitioner is languishing in custody since 21.09.2019, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge Excise, Bhagalpur in connection with Tatarpur P.S. Case No. 247 of 2019.
