Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under section 304B/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is Dewar of the deceased and on similar allegation father -in-law of the deceased has already been granted bail vide order dated 3.3.2020 passed in Cr. Misc. no. 12432 of 2020. The petitioner is in custody since 5.7.2021. One case under sections 323, 379, 504 and 506 IPC is also against the petitioner, in which he is on bail.

No.6286 of 2022(2) dt.25-05-2022 2/2 Considering the fact that on similar allegation, father-inlaw of the deceased has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case no. 683 of 2019.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) s.hassan/- U T
