JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 This is an application for grant of anticipatory bail in connection with Mohania P.S. Case No. 548 of 2018, disclosing offences under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant and others causing injury to them.

Submission of learned counsel for the petitioners is that the allegation is general and omnibus and there is land dispute and title suit is going on between the parties. Further, all injuries are simple in nature, which will appear from the impugned order.

Heard learned A.P.P. as well as learned counsel for the informant.

No.4920 of 2019(2) dt.29-01-2019 2/2 Having heard both sides, considering the above submission, this application is disposed of with a direction to the learned court below to verify the injury of the injured persons and if it is found to be simple in nature, the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Mohania P.S. Case No. 548 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

With the above observation, this application is disposed of.
