JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-04-2022 Heard Ms. Kanika, learned advocate for the petitioners and Mr. Aslam Ansari for the State. The petitioners seek bail in anticipation of their arrest in connection with Marauna P.S. Case No. 42 of 2020 dated 02.04.2020 instituted for the offences under Sections 341, 323, 307, 354B, 379, 504/34 of the Indian Penal Code. The petitioners are said to have assaulted the Informant and his brother respectively.
The impugned order does not refer to the nature of injuries suffered by the victim.
In order to ascertain the nature of the injuries, case diary was called for vide order dated 07.03.2022 and provisional
Patna High Court CR. MISC. No.17236 of 2021(3) dt.28-04-2022 2/2 bail was granted to the petitioners.
While granting provisional bail to the petitioners, it was taken note of the fact that there was a delay of four days in lodging the F.I.R.
The injury reports of the victim which is part of the case diary which has been received in this Court, indicates that the injuries are simple in nature.
Considering the aforenoted fact, the provisional bail granted to the petitioner vide order dated 07.03.2022 is hereby confirmed.
The petitioners shall remain on the same bail bonds. The application stands disposed of.
