JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. Petitioner is not named and it appears from perusal of case diary that stolen vehicle of the present case was recovered from a motor garage for which Ahiyapur P.S. Case No. 767 of 2018 was registered. The petitioner was made accused in the aforesaid case and confessed his guilt disclosing his involvement in the present case. Admittedly, petitioner has already been granted privilege of bail by learned Chief Judicial Magistrate, Muzaffarpur in Ahiyapur P.S. Case No. 767 of 2018 and except the present case as well as Ahiyapur P.S. Case

Patna High Court CR. MISC. No.3989 of 2019(3) dt.29-03-2019 2/2 No. 767 of 2018, there appears to be nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Gaurichak P.S. Case No. 239 of 2018.
