JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be cousin brother of the informant and the informant claims that 10 to 15 days prior to the alleged occurrence, petitioner had given threatening of dire consequences to the informant as well as the deceased. Admittedly, neither informant nor any person has seen the actual killing of the deceased but it appears that in course of investigation, one Veena Devi, who happens to be cousin daughter-in-law of the deceased, was arrested and confessed her guilt disclosing this fact that she had illicit relation with one Roshan Kumar but deceased came to know about the aforesaid relationship and that was the reason, she with the help of Roshan

Patna High Court Cr.Misc. No.23498 of 2016 (3) dt.12-07-2016 2/2 Kumar got eliminated the deceased. Moreover, it is informed on behalf of the petitioner that after due investigation, police submitted final form in respect of the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S.Case No.77 of 2016.
