The petitioner seeks bail in Kadamkuan P.S. Case No. 213/2015, registered for the offences punishable under Section 376 and other Sections of the Indian Penal Code. The prosecutrix herself stated in her fardbeyan that the petitioner fell in love with her for the last ten years and on the pretext of marriage, the petitioner established physical relation but later on he refused to marry.
It appears that the victim is a major girl. She disclosed her age to be 29 years in her statement. The victim appears to be a consenting party to have sexual relation with the petitioner. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each
