The petitioner is languishing in custody since 03.11.2018 in a case registered for the offences punishable under Sections 384 and 387 of the Indian Penal Code. The prosecution case is that Rs.Twenty Five lakhs was demanded by the petitioner as extortion for allowing the informant to erect a boundary wall on his purchased land. It is submitted by learned counsel for the petitioner that in the background of political rivalry, the accusation has been levelled and even assuming the accusation to be true only a case under Section 385 of the IPC is made out which is bailable. Learned APP submits that the accusation is specific

Patna High Court Cr.Misc. No.8712 of 2019(2) dt.14-02-2019 2/2 against the petitioner.

Considering the fact that the investigation has already been concluded and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Siwan in connection with Mairwa P.S. Case No. 303 of 2018.
