JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Agam Kuan P.S.Case No. 108 of 2016 registered under Sections 3(1), 3(2), 4, 5, 6 and 7 of Immoral Traffic Act, 1956 pending in the court of A.C.J.M., Patna City, Patna.
It is alleged by the informant (Officer Incharge of Agam Kuan Police Station, Patna) that on receiving information he along with police personnel raided the house of the petitioner and found three girls and three boys in objectionable condition along with Soni Verma (petitioner). The police apprehended two boys and three girls and one person Aditya Kumar managed to escape. On being asked the petitioner disclosed that she had hired
Patna High Court Cr.Misc. No.24439 of 2016 (4) dt.08-08-2016 2/2 the flat from Alok Tiwari. She further disclosed the name of the person who fled away as Aditya Kumar.
It is submitted on behalf of the petitioner that the petitioner is in custody since 01.04.2016.Charge sheet has been submitted in this case. There is no allegation of tampering of the witnesses against the petitioner. The petitioner has been made accused due to mistake of fact. Section 6 of Immoral Traffic Act is not made out.
On behalf of the State, it is submitted that the petitioner is named in the FIR, who was apprehended at the spot. The victim girls have made specific allegation against the petitioner.
Considering the aforesaid facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage and same is rejected.
