Writ petition has been filed claiming benefit of Assured Career Progression Scheme.

Counter affidavit has been filed after due service upon petitioner's counsel in June, 2017. The averments made therein are not denied or disputed as no rejoinder or reply to the counter affidavit has been filed till date. The respondents, in paragraph 10, have given details of the financial progression granted to the petitioner on completion of 10 years of service with effect from

Patna High Court CWJC No.14955 of 2014(2) dt.15-10-2019 2/2 02.03.2006 in the pay scale of Rs 5000 - 150 - 8000 and on completion of 20 years of service with effect from 02.03.2014 in Pay Band - 21 - 9300 - 34800 + Grade Pay 4600. The same has been granted according to the observations and directions of this Court in CWJC No 4068 of 2004.

Learned State Counsel submits that in view thereof, nothing survives in the instant proceedings.

This Court would observe that if the petitioner is aggrieved by the benefits paid to him then it would be open for him to assail the same in appropriate proceedings. Writ petition is dismissed with liberty, as aforesaid. (Madhuresh Prasad, J) M.E.H./- U
