JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Sursand P.S.Case No. 221 of 2015 registered under Sections 147, 148, 149, 241, 323, 307, 302, 504 and 506 of the Indian Penal Code.

It is contended that the petitioners are ladies. They have falsely been implicated in the present case. The allegation, according to the FIR, is that in all 13 persons including the three petitioners indiscriminately assaulted the father of the informant with lathi, khanti and bamboo. The submission is that the postmortem report indicates only two injuries on the person of the

Patna High Court Cr.Misc. No.24111 of 2016 (2) dt.14-07-2016 2/2 deceased. It is further submitted that there is case and counter case and it is an admitted position that there is long standing land dispute between the parties.

Learned counsel for the State has opposed the application for grant of pre-arrest bail.

Regard being had to the submissions advanced at the Bar, in the event of arrest or surrender before the court below within four weeks from today, the petitioners, namely, Sakila Khatoon alias Sakina Khatoon, Raushan Khatoon and Samina Khatun are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 221 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Pradeep/- U T
