Petitioner seeks bail in Jehanabad P.S. Case No. 829/2018 registered for the offence punishable under Sections 413/414 of the Indian Penal Code.

Informant is a Police Officer who has stated that after receiving confidential information, he went on the spot and after seeing the police party, the petitioner and other co-accused tried to flee away with motorcycle but on chase, both of them were apprehended. On demand, they could not produce any paper regarding said motorcycle and told that it is a theft motorcycle. From their possession, two apparatus of iron rod

Patna High Court Cr.Misc. No.7327 of 2019(2) dt.25-02-2019 2/3 which were being used for breaking the lock were recovered. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case due to local village politics. No incriminating material was recovered from the conscious possession of the petitioner and two apparatus of iron rod was recovered from the right side pocket of the co-accused Sonu Kumar. Petitioner is in custody since 20.10.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Jehanabad in connection with Jehanabad P.S. Case No. 829/2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the
