In this case, the petitioner is seeking bail in connection with Railway (Bhagalpur) P.S. Case No. 57 of 2015 registered for offences under sections 379 and 411 of the Indian Penal Code.

This Court is not deciding the case on merit but, only on the ground of suppression of fact. In paragraph no.3, learned counsel for the petitioner has specifically stated that the petitioner has got no criminal antecedent but, the impugned order itself discloses that the petitioner is an accused in Ishakchak P.S. Case No. 90 of 2014 for offence under Section 457/380 of the Indian Penal Code and, in that case, the police has also submitted charge-
