The petitioners are in custody in connection with G.O. Case No. 165 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. In the instant case total 27 ltrs of Nepali Saufi Wine was recovered. Learned counsel for the petitioners further submits that nothing was recovered from the conscious possession of the petitioners. The petitioners are in custody since 13.12.2019.

Considering the fact that the petitioners have got a

Patna High Court CR. MISC. No.5355 of 2020(2) dt.31-01-2020 2/2 clean antecedent, the Court is inclined to grant bail to the petitioners. Let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II cum Special Judge (Excise Act), Sitamarhi, in connection with G.O. Case No. 165 of 2019.
