JUSTICE SHIVAJI PANDEY ORAL ORDER 30-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Buniyadganj P.S. Case No. 02 of 2016 registered for offences under sections 147, 148, 149, 341, 342, 323, 324, 326, 337, 338, 332, 333, 307, 353, 427 and 395 of the Indian Penal Code and Section 3 of the Damage to Public Property Act. An allegation has been made that the Informant and excise personnel were returning after conducting raid and when they reached Bhui Toli, 20-25 persons, ladies and gents, started brickbat with the Informant and police personnel and forcibly took away rifle from the SAP Jawan. The name of the petitioner has surfaced on the statement of Bindu Kumar and Manoj Chaudhary

Patna High Court Cr.Misc. No.23572 of 2016 (2) dt.30-05-2016 who were arrested by the police at the spot itself. Learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner and so much so that Dara Chaudhary and Suresh Chaudhary have been granted bail by order dated 18.4.2016 in Cr. Misc. No. 13391 of 2016. Bindu Kumar and Manoj Chaudhary have also been granted bail by order dated 9.5.2016 in Cr. Misc. No. 20126 of 2016. As there is no specific allegation against the petitioner, let the petitioner, namely, Shyam Manjhi @ Shyama Manjhi, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gaya in connection with Buniyadganj P.S.
