JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 This is an application for grant of anticipatory bail in connection with Danapur P.S. Case No. 498 of 2018, disclosing offences under Sections 147, 408, 409, 341, 323, 324, 386, 387, 467, 468, 420, 406, 120(B) and 34 of the Indian Penal Code. Allegation against the petitioners is that they along with others threatened the brother of the complainant and his lawyer and due to that lawyer of the complainant refused to do Parvi and argument in Danapur P.S. Case No.547 of 2017 and further allegation is that petitioners along with other accused persons came variously armed and threatened the complainant of dire consequences. Further it appears that the petitioners are accused in several other cases.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.6161 of 2019(3) dt.01-04-2019 2/2 that both the parties are advocates and at the instance of the complainant other cases have been lodged and in one case i.e. Danapur P.S. Case No.547 of 2017 already final form has been submitted showing that the petitioner has not sent up. Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners stating that the petitioners have criminal antecedents and they have accused in four other cases including the case of forgery.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Danapur, in connection with Danapur P.S. Case No. 498 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
