The petitioner is languishing in custody since 01.06.2018 in connection with Salimpur P.S. Case No.79 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 448, 452, 307, 504 of the Indian Penal Code and 27 of Arms Act.

Prosecution case as per the written report of Santosh Kumar submitted to S.H.O. Salimpur P.S. is to the effect that on 28.03.2018 at about 8:00 A.M., in the background of earlier land dispute, the petitioner along with five other accused persons came in the house of the informant and started abusing and it is alleged that the co-accused, Hareram and the petitioner fired

Patna High Court Cr.Misc. No.5869 of 2019(2) dt.04-02-2019 2/2 upon the father of the informant causing injury on his left hand and armpit.

It is submitted by learned counsel for the petitioner that in the background of dispute, accusation has been levelled. There is a counter version being Salimpur P.S. Case No.869 of 2014. The investigation has already been concluded Moreover, the co-accused, Hare Ram Kumar has been granted bail by a Co-oordinate Bench of this Court vide order dated 18.01.2019 passed in Cr. Misc. No.79300 of 2018.

Considering the genesis of accusation, there being a counter case filed against the informant's side, the investigation being concluded and there being no medical opinion to corroborate the injury and co-accused person being granted bail by a Co-ordinate Bench of this Court, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge 3rd Barh, Patna in connection with Salimpur P.S.
