03-03-2020 Heard learned counsel for the parties.
The petitioner apprehends his arrest in Kotwali (Barari) P.S. Case No. 410 of 2019 registered for the offence under Sections 323, 341, 354(B), 386, 504, 506/34 of the Indian Penal Code.
In the F.I.R., the informant, who is betel-shop owner, has alleged that petitioner has demanded Rs. One lac, as Rangdari, and also tried to outrage her modesty. It is submitted on behalf of petitioner that petitioner is next door neighbour and he has falsely been implicated in this case due to village politics. No such occurrence has taken place. It is further submitted that no offence under Section 354(B) of the Indian Penal Code is made out against the petitioner. No
Patna High Court CR. MISC. No.3949 of 2020(2) dt.03-03-2020 2/2 injury has been caused to the informant. Petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 410 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
