The petitioner apprehends his arrest in connection with Dhanarua P.S. Case No. 77 of 2019 for the offence punishable under Sections 25(1-b)a/26/35 of the Arms Act. The allegation is regarding the police having apprehended a TATA Sumo vehicle from which one country made pistol and one live cartridge was recovered. The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and is having a clean antecedent. It is further submitted that in paragraph no. 6 of the present petition, it has been categorically stated that the petitioner was not driving the vehicle, rather he is the owner of the vehicle and had given it to

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, coupled with the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner on anticipatory bail. Accordingly, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner, above named, is directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Masourhi in connection with Dhanarua P.S. Case No. 77 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) Tiwary/- U T
