This application for regular bail arises out of Baligaon P.S. Case No. 66 of 2019, disclosing offences punishable under Section 392/34 of the Indian Penal Code. The First Information Report was registered against unknown with the allegation of robbery against two persons, who could not be identified by the informant. Names of the petitioner and other persons, namely, Ashish Kumar, have surfaced on the basis of their confessional statement taken by the police during the course of investigation of Patepur P.S. Case No.n193 of 2019.
Learned counsel for the petitioner has submitted that the said Ashish Kumar has been allowed regular bail by this
Patna High Court CR. MISC. No.4698 of 2020(4) dt.01-06-2020 2/2 Court by an order dated 23.01.2020 passed in Cr. Misc. No. 3975 of 2020. She has submitted that the petitioner has been made accused in other cases only after his arrest in Patepur P.S. Case No. 193 of 2019.
Considering the submission that co-accused Ashish Kumar has been granted regular bail by this Court, this application is allowed.
Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XVI-cum- SubJudge-XVII, Vaishali at Hazipur in Baligaon P.S. Case No. 66 of 2019 (GR No. 3903 of 2019).
It is, however, ordered that in case the petitioner is found in such activities in future, the prosecution shall be obliged to approach this Court for cancellation of bail granted, in all such cases in which he is involved.
