JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-B) A and 26 of the Arms Act.

Allegation is that arms used in Ladania P.S. Case no. 163 of 2015 have been recovered from a black bag which was kept in petitioner's room.

It has been submitted on behalf of the petitioner that he is in custody since 17.2.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of evidence is there against the petitioner. One country made pistol and two live cartridges are said to have been recovered. No compliance of Section 100 Cr. P.C. has been made.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.24090 of 2016 (3) dt.05-08-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IIIrd, Rosera, Samastipur, in connection with Bibhutipur P.S. Case no. 255 of 2015.
