The petitioner is in custody since 03.02.2016 in connection with Warisaliganj P.S. Case No. 266 of 2015 for the offence registered under Sections 302/201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is not named in the FIR, he is facing prosecution only on the basis of the confessional statement made by the co-accused, Gopal Singh, arrested from the place where the dead body was recovered alleging that the petitioner was also present at the house of co-accused Prahalad Singh where the alleged occurrence is said to have taken place.

No.22914 of 2016 (2) dt.30-05-2016 Considering the fact that the name of the petitioner has come on the confessional statement made before the police and that no specific role has been attributed to him, save and except, his presence at the place of occurrence and also that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Nawada in connection with Warisaliganj P.S.
