The petitioner seeks bail in connection with Special Case No. 8778 of 2021 arising out of Gandhi Maidan P.S. Case No. 614 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.12.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 43.41 litres of liquor from bags. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, he was a mere passerby, the bags do not belong to him and the real culprits had

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Special Case No. 8778 of 2021 arising out of Gandhi Maidan P.S. Case No. 614 of 2021.
