2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 379, 506 and 34 of the Indian Penal Code and later, Section 307 of the Indian Penal Code was added.

3. As per prosecution case, this petitioner is alleged to have assaulted informant and his wife as a result of which informant sustained grievous injuries.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. There is admitted land dispute between the parties due to which this false and concocted case has been lodged. The present F.I.R. has been lodged after inordinate delay of 2 days and there is no

It is further submitted that the dispute between the parties has already been settled and a compromise petition to that effect has also been filed before the learned trial court, copy of which is Annexure-3 to this application. Charge-sheet has already been submitted and petitioner is in custody since 23.10.2024.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation, compromise between the parties and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Jiyapokhar P.S. Case No. 41 of 2023. (Prabhat Kumar Singh, J) shashank/- U T
