No doubt, dead body of the deceased was recovered in front of the house of the petitioner but according to the prosecution case itself, informant is not an eye-witness of the alleged occurrence and furthermore, in course of investigation, not a single prosecution witness claimed to have seen the actual killing of the deceased. Annexure 2 to the petition reveals that having more or less similar allegation one co-accused has already been granted privilege of bail by a coordinate bench of this court.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri R. Mishra, Judicial Magistrate, Ist Class, Begusarai/concerned court in Birpur P.S. Case no. 40/2014. shahid (Hemant Kumar Srivastava,J) U T
