The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code. As per the prosecution case, on the order of Ex-MLA Amar Yadav petitioner is alleged to have fired and hit on the head of the injured.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that co-accused on whose order petitioner is alleged to have fired on the injured, has not been chargesheeted by the police. Petitioner is in custody since 29.2.2020. Learned counsel appearing for the State and the

Patna High Court CR. MISC. No.17188 of 2021(3) dt.19-08-2021 2/2 informant oppose the prayer for bail. They submit that the petitioner evaded the process of law and absconded for 16 years and he has been arrested after exhausting processes under sections 82/83 Cr.P.C. and there is specific allegation against him that he fired on the injured.

Considering the rival submissions of the parties and materials available on the record, prayer for bail of the petitioner is refused.
