JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named and it appears that stolen motorcycle was recovered near a tree where petitioner and three other persons were found standing. Admittedly, the aforesaid recovery has not been made from conscious possession of the petitioner and moreover, having more or less similar allegation, one co-accused has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.34449 of 2015 (2) dt.21-08-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Town (Begusarai) P.S. Case No. 99 of 2015.
