Learned counsel appearing on behalf of the petitioner submits that respondents have introduced MACP Scheme which provides 3rd MACP on completion of 30 years of service. Counsel submits that petitioner is qualified for grant of 3rd MACP but due to the reluctance of the respondents, petitioner has not been granted the benefit of 3rd MACP. Considering the fact that the petitioner has superannuated in 2017, the writ petition is disposed of with the direction to the respondents to examine the claim of the petitioner for grant of 3rd MACP under the MACP Rules and if it
Patna High Court CWJC No.13734 of 2017(2) dt.20-02-2020 2/2 is found that 3rd MACP is admissible on completion of 30 years of service, the claim of the petitioner should be considered accordingly and he should be granted the benefit of the same. Appropriate decision in this regard, with all consequential benefit, must be taken within the maximum period of four months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petition stands disposed of.
