JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kishanganj P.S. Case No. 13 of 2018 registered for the offences punishable under Sections 363, 366A of the Indian Penal Code and Sections 4/6 of the POCSO Act. Allegation as per FIR is of kidnapping of daughter of nephew of the informant.

Submission of learned counsel for the petitioner is that with respect to kidnapping of Rinku Kumari, daughter of nephew of the informant, Banmankhi P.S.Case No. 138 of 2016 was lodged by the father of Rinku Kumari in which son of the petitioner Arun Kumar Mandal has been granted anticipatory bail vide order dated 3.4.2018 passed in Cr.Misc.No. 3107 of 2018. However, after that the present case has been filed by the maternal uncle of the father of Rinku Kumari against the

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District JudgeI, Kishanganj, in connection with Kishanganj P.S.Case No. 13 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
